Welcome to Smonk. These Terms & Conditions ("Terms") govern your use of the Smonk platform and services operated by Velozity Global Solutions India Private Limited ("we", "us", or "our"). By accessing or using smonk.ai (the "Service"), you agree to be bound by these Terms.

1. Eligibility

You must be at least 16 years of age to use the Service. By using Smonk, you represent that you meet this requirement and that all information you provide is accurate and complete.

2. Account Registration

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You agree to provide accurate, current, and complete information during registration.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit false, misleading, or fraudulent information
  • Impersonate another person or entity
  • Attempt to gain unauthorized access to the Service or related systems
  • Use automated scripts, bots, or scrapers to access the Service without permission
  • Harass, abuse, or harm other users
  • Upload malicious code, viruses, or harmful content
  • Use the outreach features to send spam or unsolicited bulk communications
  • Circumvent or attempt to circumvent usage limits or rate controls

4. AI-Generated Content

The Service uses artificial intelligence to generate resumes, cover letters, outreach emails, interview questions, and other content. You acknowledge that:

  • AI-generated content is provided as suggestions and may require your review and editing
  • You are solely responsible for the accuracy and appropriateness of content you send to employers
  • AI outputs may occasionally contain errors or inaccuracies
  • We do not guarantee any specific outcomes from using AI-generated content

5. Job Listings & Scam Detection

We aggregate job listings from third-party sources and apply automated scam detection (Trust Score). However:

  • We do not guarantee the accuracy, legitimacy, or completeness of any job listing
  • The Trust Score is an automated assessment and may not catch all fraudulent listings
  • You should exercise your own judgment when applying to or interacting with employers
  • We are not a party to any employment agreement between you and an employer

6. Subscriptions & Payments

  • Free accounts are available with limited features as described on our pricing page
  • Paid subscriptions (Pro, Max) are billed monthly and renew automatically
  • You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
  • Credits included in your plan refill monthly and do not roll over
  • Prices are in Indian Rupees (INR) and may be subject to applicable taxes
  • We reserve the right to change pricing with 30 days' notice

7. Intellectual Property

  • The Service, including its design, code, and branding, is owned by Velozity Global Solutions India Private Limited
  • You retain ownership of the personal content you upload (resumes, projects, etc.)
  • You grant us a limited license to process your content for the purpose of providing the Service
  • AI-generated content created using our Service is yours to use freely

8. Outreach & Email Features

When using our cold email and outreach features:

  • You authorize us to send emails on your behalf to hiring managers and recruiters
  • You agree that outreach messages accurately represent your intentions
  • You are responsible for complying with applicable anti-spam laws
  • We may limit the number of outreach emails to prevent abuse

9. Limitation of Liability

To the maximum extent permitted by law, Velozity Global Solutions India Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or opportunities, arising from your use of the Service.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

  • The Service will be uninterrupted, secure, or error-free
  • You will receive any specific number of interviews or job offers
  • Job listings are accurate or legitimate despite our scam detection efforts
  • AI-generated content will be error-free or suitable for all purposes

11. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.
